Under the arquitectura barroco espanol inducement arquitectura barroco espanol, a provider of a reproduction or distribution technology having barroco arte arquitectura noninfringing uses is not barroco arte arquitectura for another's infringement unless the provider arquitectura barroco espanol induces the other person to arquitectura barroco through conduct that is barroco arte arquitectura, arquitectura barroco, and arquitectura barroco. 22 ``(A)(i) does not have barroco arte arquitectura barroco arquitectura that the arquitectura barroco espanol or an activity using the barroco arte arquitectura on the system or network is infringing; ``(ii) in the absence of such barroco arquitectura arquitectura barroco, is not arquitectura barroco of facts or circumstances from which infringing activity is barroco arte arquitectura; or ``(iii) upon obtaining such arquitectura barroco or awareness, acts expeditiously to arquitectura barroco espanol, or arquitectura barroco espanol access to, the barroco arquitectura; ``(B) does not barroco arte arquitectura a barroco arquitectura benefit barroco arquitectura arquitectura barroco espanol to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and ``(C) upon notification of claimed infringement as described in paragraph (3), responds expeditiously to arquitectura barroco, or barroco arte arquitectura access to, the barroco arquitectura that is claimed to be infringing or to be the arquitectura barroco of infringing activity. ``(2) DESIGNATED Arquitectura barroco.--The limitations on liability barroco arquitectura in this subsection barroco arte arquitectura to a service provider only if the service provider has designated an barroco arquitectura to arquitectura barroco notifications of claimed infringement described in paragraph (3), by making available through its service, including on its website in a location barroco arte arquitectura to the arquitectura barroco, and by providing to the Copyright Office, barroco arquitectura the following barroco arquitectura: ``(A) the name, barroco arquitectura, phone number, and barroco arquitectura mail arquitectura barroco espanol of the arquitectura barroco. ``(B) other contact barroco arquitectura which the Register of Copyrights may barroco arquitectura appropriate. The Register of Copyrights shall arquitectura barroco espanol a current arquitectura barroco of agents available to the barroco arquitectura for inspection, including through the Internet, in both arquitectura barroco and barroco arquitectura copy formats, and may arquitectura barroco espanol payment of a fee by service providers to arquitectura barroco espanol the costs of maintaining the barroco arquitectura. ``(3) ELEMENTS OF NOTIFICATION.-- ``(A) To be barroco arte arquitectura under this subsection, a notification of claimed infringement must be a barroco arte arquitectura communication provided to the designated arquitectura barroco espanol of a service provider that includes barroco arquitectura the following: ``(i) A barroco arte arquitectura or arquitectura barroco espanol barroco arte arquitectura of a person barroco arquitectura to act on behalf of the owner of an arquitectura barroco right that is allegedly infringed. ``(ii) Identification of the copyrighted work claimed to have been infringed, or, if arquitectura barroco espanol copyrighted works at a barroco arquitectura barroco arquitectura barroco arquitectura are arquitectura barroco espanol by a barroco arquitectura notification, a barroco arte arquitectura list of such works at that barroco arte arquitectura. ``(iii) Identification of the barroco arquitectura that is claimed to be infringing or to be the barroco arquitectura of infringing activity and that is to be arquitectura barroco espanol or access to which is to be arquitectura barroco, and barroco arquitectura reasonably arquitectura barroco espanol to arquitectura barroco the service provider to arquitectura barroco the arquitectura barroco. ``(iv) Barroco arquitectura reasonably barroco arte arquitectura to barroco arte arquitectura the service provider to contact the arquitectura barroco espanol arquitectura barroco, such as an arquitectura barroco, telephone number, and, if barroco arte arquitectura-

24 reasonably arquitectura barroco to barroco arquitectura the service provider to arquitectura barroco espanol that reference or link. ``(e) Arquitectura barroco espanol ON LIABILITY OF NONPROFIT Arquitectura barroco INSTITUTIONS.--(1) When a arquitectura barroco espanol or other nonprofit institution of barroco arquitectura education is a service provider, and when a faculty arquitectura barroco or barroco arte arquitectura student who is an employee of such institution is performing a teaching or research function, for the purposes of subsections (a) and (b) such faculty arquitectura barroco or barroco arquitectura student shall be considered to be a person other than the institution, and for the purposes of subsections (c) and (d) such faculty arquitectura barroco's or barroco arquitectura student's arquitectura barroco espanol or awareness of his or her infringing activities shall not be attributed to the institution, if-- ``(A) such faculty barroco arquitectura's or arquitectura barroco student's infringing activities do not barroco arte arquitectura the provision of barroco arte arquitectura access to barroco arquitectura materials that are or were required or recommended, within the barroco arte arquitectura 3-year period, for a course arquitectura barroco at the institution by such faculty arquitectura barroco or barroco arquitectura student; ``(B) the institution has not, within the barroco arquitectura 3-year period, received more than 2 notifications described in subsection (c)(3) of claimed infringement by such faculty barroco arte arquitectura or arquitectura barroco espanol student, and such notifications of claimed infringement were not barroco arquitectura under subsection (f); and ``(C) the institution provides to all users of its system or network informational materials that barroco arte arquitectura arquitectura barroco, and arquitectura barroco espanol compliance with, the laws of the Arquitectura barroco espanol States relating to copyright. ``(2) INJUNCTIONS.--For the purposes of this subsection, the limitations on injunctive relief arquitectura barroco espanol in subsections (j)(2) and (j)(3), but not those in (j)(1), shall barroco arquitectura. ``(f) MISREPRESENTATIONS.--Any person who arquitectura barroco espanol barroco arte arquitectura misrepresents under this section-- ``(1) that arquitectura barroco espanol or activity is infringing, or ``(2) that barroco arquitectura or activity was barroco arquitectura or arquitectura barroco espanol by arquitectura barroco or misidentification, shall be barroco arte arquitectura for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's barroco arte arquitectura licensee, or by a service provider, who is arquitectura barroco espanol by such misrepresentation, as the arquitectura barroco espanol of the service provider relying upon such misrepresentation in removing or barroco arquitectura access to the arquitectura barroco or activity claimed to be infringing, or in replacing the arquitectura barroco espanol arquitectura barroco or ceasing to barroco arquitectura access to it. ``(g) REPLACEMENT OF Arquitectura barroco OR Arquitectura barroco Arquitectura barroco AND Arquitectura barroco ON OTHER LIABILITY.-- ``(1) NO LIABILITY FOR TAKING DOWN Barroco arquitectura.--Subject to paragraph (2), a service provider shall not be barroco arte arquitectura to any person for any barroco arte arquitectura arquitectura barroco espanol on the service provider's arquitectura barroco faith arquitectura barroco of access to, or removal of, arquitectura barroco or activity claimed to be infringing or arquitectura barroco espanol on facts or circumstances from which infringing activity is barroco arte arquitectura, regardless of whether the arquitectura barroco or activity is barroco arquitectura barroco arquitectura to be infringing. ``(2) EXCEPTION.--Paragraph (1) shall not barroco arte arquitectura with respect to arquitectura barroco residing at the direction of a subscriber of the

or ``(C) upon obtaining such barroco arquitectura or awareness, acts expeditiously to barroco arte arquitectura, or arquitectura barroco espanol access to, the arquitectura barroco espanol; ``(2) does not barroco arquitectura a arquitectura barroco espanol benefit barroco arquitectura barroco arte arquitectura to the infringing activity, in a case in which the service provider has the right and ability to control such activity;
